Notes for Johannis Theunise SPIER
The second son of Theunis and Catalyntje lived on part of the old homestead farm on the Wesel road south of Crooks avenue. During the Revolution he was a second Lieutenant in the Essex Company under Capt. John Craig.676 He served from 29 Dec 1781 - 15 Dec 1782. He was wounded by a bullet passing under his neck and which came out of his mouth. He did not die of this wound however.

In the name of God amen. I John T. Spear of the Township of Aquackanonk, in the county of Essex and the state of New Jersey Being of sound and perfect mind and memory do make and publish this my last will and Testament in Manner following;
1st I give and bequeath unto my three sons Tunis, Albert and John all my clothes to be divided equally among them. 2nd. I give and bequeath unto my wife Elizabeth all my real and personal estate during the time she remains my widow to use the income of the same and as much of the principle as her support may require 3rd. After the widowhood or decease of my wife Elizabeth, I give and bequeath all the residues of my estate, real and personal unto my five children, vis: Tunis, Albert, John, Maria and Elizabeth to be divided equally among them: if any of my children should die before the decease of my wife Elizabeth then the heir or heirs of such child must inherit the share. 4th. I authorise my executors to sell all my property real and personal after the decease of my wife Elisabeth and to make an equal distribution of the same to my heirs. And lastly I nominate, constitute and appoint my three sons, Tunis, Albert and John Spear executors of this my last will and testament hereby revoking all former wills and Testaments by me at any time made, and satisfying and confirming this and no other to be my last. In witness whereof I have hereunto set my hand and seal this seventh day of June, In the year of our Lord one thousand eight hundred and thirty-three. [signature of John T. Spear]

Essex County Daniel G. Demarest, one of the witnesses to the annexed writing purporting to be the last will and testament of John T. Speer, the testator therein named deceased being duly sworn, deposeth and saith that he saw the said testator sign and seal the said annexed writing and heard him publish the same as and for his last will and testament, that at the time of the doing thereof the said testator was of sound disposing mind and memory as far as this deponant knows and so verily believes that Garret Terhune and [copy cut off here]
Essex County Tunis I Spear, Albert I. Spear and John I Spear, the Executors in the annexed writings named, being duly sworn, do severally depose and say that the said annexed writing contains the true last will and testament of John T. Spear, the testator therein named deceased as far as they know and as they verily believe respectively That they will well and truly perform the same, first by paying the debts of said deceased, and then the bequests therein specified as far as the goods, chattels and credits of said deceased will therein extend and the law charge them That they will make and exhibit unto the Surrogates office of the County of Essex a true and perfect Inventory of all and singular, the said goods and chattel, rights and credits as far as the same have or shall come to their possession or Knowledge respectively or to the possession. of any other person or persons to their use to their Knowledge respectively and that they will well and truly account what thereunto lawfully required
